ACCESS TO PUBLIC INFORMATION

 

The procedure for exercising and ensuring the right of everyone to access information held by public authorities and other managers of public information and information of public interest is set out in the Law of Ukraine «On Access to Public Information».

 

The procedure for access to public information managed by Odesa State University of Internal Affairs is regulated by Order of the Ministry of Internal Affairs No. 339 dated 05.05.2021.

 

Access to public information of Odesa State University of Internal Affairs is provided by providing information upon requests for information. The requesters of public information are individuals, legal entities and associations of citizens without the status of a legal entity, except for public authorities.

 

Public information means information reflected and documented by any means and on any media that has been received or created in the course of performing its duties by Odesa State University of Internal Affairs or that is in the possession of the university.

 

A request for information is a person's request to Odesa State University of Internal Affairs to provide public information in its possession. The requester has the right to apply to the information manager with a request for information, regardless of whether the information concerns him or her personally or not, without explaining the reason for the request.

 

A request for information may be denied if

 

  • the university does not possess and is not obliged, in accordance with its competence under the law, to possess the information requested;

 

  • the requested information belongs to the category of information with limited access (confidential, secret, proprietary);

 

  • the person who submitted the request for information did not pay the actual costs associated with copying or printing;

 

  • the requirements for a request for information are not met.

 

The request for information should include

 

  • name (surname) of the requestor, postal address or e-mail address, as well as the number of the means of communication;

 

  • a general description of the information or the type, name, details or content of the document requested;

 

  • signature and date if the request is made in writing.

 

A response to a request for information shall be provided no later than five business days from the date of receipt of the request, except when the request concerns information necessary to protect the life or freedom of a person, the state of the environment, the quality of food and household items, accidents, disasters, etc., when the response shall be provided no later than 48 hours from the date of receipt of the request.

 

If the request concerns the provision of a large amount of information or requires searching for information among a significant amount of data, the time limit for reviewing the request may be extended up to 20 business days, and the requestor shall be notified of this.

 

If the request for information is an appeal by its nature, it is considered in accordance with the procedure provided for by the Law of Ukraine «On Citizens' Appeals», and the requestor is informed of this within five days.

 

If the request for information contains questions, some of which are requests for information and some of which are appeals, its consideration is carried out in accordance with the requirements of the law on consideration of requests and appeals, respectively.
