Legal Clinic

In accordance with the Law of Ukraine «On Higher Education», Presidential Decree № 992 of October 18, 2001 «On the National Program of Legal Education of the Population», implementing the recommendations of the All-Ukrainian Interagency Coordination and Methodological Council for Legal Education of the Population and with the aim of creating appropriate conditions for citizens to acquire the necessary legal knowledge and skills in their application, providing free legal aid to persons in need of social protection and support, as well as to provide senior law students with practical legal skills, the legal clinic of the Odesa State University of Internal Affairs was established by order of the rector of OSUIA № 60 of February 26, 2013.

 

The Legal Clinic is a structural unit of the Odesa State University of Internal Affairs and operates on the basis of the current legislation of Ukraine, the Charter of the OSIA and the Regulations on the Legal Clinic of OSUIA.

 

The basis of the legal clinic's functioning is a combination of interests of citizens in need of legal aid and unable to pay for legal services, students interested in gaining practical knowledge that will help them in their future employment and career.

 

GOALS AND OBJECTIVES OF THE LEGAL CLINIC OF ODESA STATE UNIVERSITY OF INTERNAL AFFAIRS

 

1. The purpose of the Legal Clinic is:

 

- To educate a new generation of lawyers related to the formation of an understanding of the socially oriented content of the legal profession and their awareness of the human rights role of a lawyer in modern society.

 

- Practical training and education of future lawyers in compliance with the principles of the rule of law, human rights and freedoms, justice and human dignity and respect for them.

 

- Improving the level of practical knowledge, skills and abilities of law students of the University.

 

- Ensuring access to legal aid for representatives of socially vulnerable groups of society.

 

- Formation of legal culture of citizens.

 

- Expansion of cooperation of the University with judicial and law enforcement agencies, state and local authorities, other institutions and organizations.

 

2. The main objectives of the Legal Clinic:

 

- Providing senior students who participate in the activities of the Legal Clinic (student clinicians) with the opportunity to acquire practical skills in their specialty.

 

- Creating places for students to undergo training, industrial, pre-diploma and master's practice.

 

- Assistance to law students of the University in mastering practical skills of providing legal aid to the public, interactive teaching methods and analysis of law enforcement practice.

 

- Providing free legal advice to citizens.

 

- Conducting events on legal education of the population and raising the level of its legal culture.

 

- Promoting the solution of social problems in the south of Ukraine by providing pro bono legal aid.

 

- Enabling law students to communicate with practitioners of judicial and law enforcement agencies, other state and local government bodies on their activities during the educational process.

 

- Establishing an effective mechanism for exchanging information between the public, the media, and the Legal Clinic, which will allow us to respond promptly to the practical needs of citizens.

 

3. In accordance with the purpose and objectives of the Legal Clinic, for its full and effective functioning, the management of the Legal Clinic and the University shall organize and provide:

 

- Conducting theoretical and practical classes based on the results of the Legal Clinic's activities.

 

- Conducting legal education, legal awareness and other educational and practical activities.

 

- Providing free legal aid on the protection of human rights and freedoms and organizations in all branches of law in accordance with the current legislation of Ukraine.

 

- Preparing and distributing publications for the public on topical legal issues.

 

- Cooperation with representatives of governmental and non-governmental bodies and organizations.

 

- Participation in scientific and practical conferences, seminars, trainings and other events on topical legal issues.

 

- Work on systematization and analysis of the practice of law enforcement agencies and courts of Ukraine, the practice of the European Court of Human Rights.

 

- Cooperation with legal clinics of other higher education institutions in Ukraine and other countries.

 

THE PROCEDURE FOR PROVIDING LEGAL AID

 

Legal aid is provided free of charge.

 

The legal clinic provides legal aid by higher education students - consultants who are not professional lawyers, under the supervision of the head of the legal clinic.

 

Legal aid is provided to citizens belonging to the least well-off groups of the population:

 

- pensioners;

 

- people with disabilities;

 

- combatants;

 

- low-income citizens;

 

- large families;

 

- single mothers.

 

AREAS OF LEGAL AID

 

- protection of constitutional rights and freedoms of citizens;

 

- civil, labor, agrarian, housing, land, family, international law and social security;

 

- provision of oral and written consultations and explanations on legal issues related to current legislation;

 

- assistance in drafting claims, complaints and other legal documents;

 

- protection of the rights of youth and minors.

- search for legal norms;

 

- drafting procedural and other documents;

 

- other legal assistance.

 

Since December 2022, the Legal Clinic of Odesa State University of Internal Affairs has been headed by Candidate of Law, Associate Professor Viktoriia Tomina, Professor of the Department of Administrative Activities of the Police.
